Terms of Use
These Terms of Use ("Terms") form a binding agreement between you and the operator of Mask regarding your access to and use of the Mask website and client applications (collectively, the "Service"). By accessing, downloading, installing, or using the Service, you acknowledge that you have read, understood, and agreed to be bound by these Terms.
1. Scope and Agreement Structure
These Terms apply to all access to and use of the Service. Related policies and notices published for the Service, including the Privacy Policy, feature descriptions, in-product notices, and update announcements, form an integral part of these Terms. In case of inconsistency, specific supplemental terms prevail.
2. Accounts and Configuration Data
The Service may operate without a centralized account system. You are responsible for safeguarding locally configured information (including, without limitation, third-party API keys, preferences, and history) and bear all risks and consequences arising from misconfiguration, leakage, or device security issues.
3. License and Use Restrictions
Subject to your compliance with these Terms, we grant you a revocable, non-exclusive, non-transferable, limited license to use the Service for lawful purposes. Except as required by applicable law, you may not:
- Use the Service for any unlawful, infringing, fraudulent, or otherwise improper purpose;
- Interfere with, disable, or circumvent any security mechanism, technical limitation, or access control of the Service;
- Copy, sell, lease, sublicense, distribute, or otherwise commercially exploit the Service without authorization;
- Use the Service to upload, process, or transmit content you are not legally entitled to process.
4. Third-Party Models and Services
You may connect to third-party model providers (including but not limited to OpenAI, Google Gemini, DeepSeek, Xiaomi Mimo, and Ollama remote deployments). You acknowledge and agree that:
- Your relationship with third-party providers, including billing and dispute handling, is solely between you and such providers;
- Third-party providers are independently responsible for their service availability, data handling, and compliance obligations;
- To the extent permitted by applicable law, we are not liable for interruptions, errors, data handling outcomes, or other losses caused by third-party services.
5. User Content and Legality Warranty
You are solely responsible for all content you input, submit, process, or generate through the Service ("User Content"). You represent and warrant that you have all rights, permissions, and legal bases required to process such User Content and that such content does not violate applicable law or any third-party rights.
6. Intellectual Property
All intellectual property rights in and to the Service and related software, interfaces, documentation, and marks are owned by us or our licensors. Without prior written consent, you may not use protected content or marks in any form. Your lawful rights in User Content are not automatically transferred to us by your use of the Service.
7. Service Changes, Suspension, and Termination
We may update, adjust, restrict, suspend, or terminate the Service based on product evolution, operational needs, security, or compliance requirements. To the extent permitted by applicable law, we are not liable for unavailability, delay, or functional changes not caused by our willful misconduct or gross negligence.
8. Disclaimer and Limitation of Liability
The Service is provided on an "as is" and "as available" basis. We make no express or implied warranties that the Service will meet your specific requirements, remain uninterrupted, be error-free, or be absolutely secure. To the extent permitted by applicable law, we are not liable for any indirect, incidental, special, punitive, or consequential damages.
9. Indemnification
You agree to defend, indemnify, and hold harmless us and our affiliates from any claims, penalties, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, applicable law, or third-party rights.
10. Updates to Terms
We may update these Terms as required by business and compliance needs. Updated versions will be published on the website or in-app; material changes will be accompanied by reasonable notice. Unless otherwise stated, updated Terms take effect upon publication. Your continued use of the Service constitutes acceptance of the updated Terms.
11. Governing Law and Dispute Resolution
The formation, validity, interpretation, performance, and dispute resolution of these Terms shall be governed by applicable law with a real connection to your place of use or the place of service provision (excluding conflict-of-law rules). In case of dispute, the parties shall first seek amicable resolution; failing that, either party may submit the dispute to a competent people's court or other legally authorized forum.
